That article doesn't state that he was unarmed, or that his hands were at his sides, both of which contradict the deputy's testimony (which says that he was brandishing the weapon and raised it). I'd be happy to have proof that the deputy was lying through his teeth, but that proof doesn't appear to exist. The fact that the gun was found in his pocket is suspicious, but not conclusive. It's possible he put it away as the officers were drawing and firing, or as he was dying (headshots aren't always insta-kills, and people do strange things as they're dying). I agree it's super suspicious, but I would expect if it were conclusive there would be articles mentioning that as directly contradicting the deputy's testimony. I'd hoped he'd found such an article, but apparently not.
