Yeah I get that, but who doesn't at some point in a fifty year relationship have sex when they don't super feel like it, when one or the other is incapacitated from booze, a little rough and tumble no, no (yes, yes). It's trying to put a high pass filter on a massive sea of gray that will turn everyone or noone complicit, making it unworkable and at the same time also diminishing actual spousal abuse. I think physical coercion and/or systemic mental abuse are good indicators to whether marital rape should be criminally punished.
